Soothing Touch Academy Terms and Conditions of Business for Students

    

1.    General

1.1  These terms and conditions apply to the services provided by Soothing Touch Academy  (‘the Academy’).

1.2  They are deemed to be accepted by the Student upon the Academy accepting the Student onto a course of study at the Academy.

1.3  No variation or alteration to these terms shall be valid unless approved in writing by a duly authorised official of the Academy on the Academy’s letter-headed stationery.  

1.4  All classes and examinations are conducted in English.  Students must have a good command of written and spoken English.

1.5  We have an excellent reputation of providing high standards for our Students and, as such, we expect all Students studying with the Academy to remain professional and ethical at all times, before, during and after attending one of our courses.

1.6  Any Student demonstrating unprofessional or unethical behaviour towards staff of the Academy or their clients including sending threatening communications or persistently contacting the Academy, before or during a course will be automatically removed from the course they are enrolled on or will be asked to leave the premises if the course is already running in order to safeguard staff and other students on the course. 

1.7  If a Student is excluded before or during a course as a result of their behaviour, this will result in an automatic lifetime exclusion from all current or future courses run by the Academy.

1.8  A Student excluded before or during a course as a result of their behaviour will not be entitled to any refunds or credit notes.

1.9  The Academy reserves the right to refuse an application without reason.

 

2.    Attendance and Course Work

2.1  If the student is unable to attend a scheduled Study Day it is important that the Principal Tutor is informed promptly.

2.2  All contact tuition hours must be completed prior to sitting for examinations.

2.3  Students must inform the Principal Tutor immediately of any medical conditions they may suffer from, which may affect their ability to give or receive any treatments in class.

2.4  The Academy reserves the right to change the location of the Course Venue.

2.5  The Academy will take all reasonable steps to ensure that no classes are cancelled. If, however, a cancellation occurs due to unavoidable circumstances (eg tutor sickness) a new class date will be provided.

2.6  Students are encouraged to stay with their Enrolling Class.  If a student wishes to change to another Class, an administrative charge of £100 will apply which will be payable by bank transfer within one month of the invoice date or the workig day before the next class starts, depending on whichever comes first.

2.7  The Academy will not accept responsibility for any loss, damage to, or theft of personal property.

2.8  Due to the intensity of the courses offered by Soothing Touch Academy, if a Student misses a practical day or 2 Anatomy days they will need to have extra tuition with the Principal Tutor which will be charged at £40 per hour and will be given at a time and location convenient to the Principal Tutor.  

2.9  It will be the responsibility of the Student to contact the Principal Tutor to find out how many tuition hours will be required and to organise a date for the catch up session before the next course date.  

2.10 Students will not be able to sit mock exams or take final exams if they have not paid either the full course fees or completed the extra tuition required, assignments, treatments and case studies by the final deadline of their respective course. 

2.11  All course work needs to be completed by the specific deadlines given out during each session and it is the Student’s responsibility to manage their own time and workload to meet every deadline as specified in their handouts.  

2.12  Any work not completed by the deadline specified in their handouts will be subject to further costs as follows:  £20 per short treatment or any other piece of homework each, £40 per case study, £100 per assignment.

2.13 The Student will receive an invoice for the above charges incurred in clause 2.12 for missing any deadlines which will become payable by bank transfer within 5 day of the invoice.

2.14 If the Student fails to pay the above invoice indicated in clause 2.13 within 5 days of the invoice date, a further charge of £50 will be added as a late payment fee.

2.15  The Student will have a further 5 days from the revised invoice date to make payment.  Failure to make this payment by bank transfer will result in the Student being suspended from the Course but the Student will still be liable for the full course fees and any charges that have been invoiced up to and including the date of suspension / termination by either party.

2.16  Late work will not be marked without all extra charges being paid within the timescales of clauses 2.12 or 2.13. 

2.17  Upon termination / suspension from a course by either party, the Academy will send a Student a final invoice to include any outstanding course fees and charges up to and including the date of suspension / termination.  The Student will have 7 days from the date of the invoice to pay this by.  

2.18  Failure by a Student to pay a final invoice within 7 days from the date of the invoice may result in further action to recover the full outstanding balance together with any interest and legal costs incurred.

 

3.    Course Fees and Cancellation

3.1  Full fees are payable on enrolment, either by one single payment, or by instalments agreed with the Academy.

3.2  The instalment plan is a concession by the Academy to help a Student with their payments and, the balance of the outstanding Course fees will become payable immediately even if the Student should fail to complete the Course through non-attendance.

3.3  Any Student who fails to keep to the instalment plan as agreed with the Academy will incur further charges as follows.  If a payment is missed as indicated on the instalment plan above, a missed payment fee of £50 will be charged.  An invoice for this amount including the missed payment will be generated which will become payable by bank transfer within 5 days of the invoice date.  Failure to pay this invoice will result in the student being suspended from the course until the account is fully up to date.  Any course fee discounts offered at time of booking will also become null and void if a payment is missed on the instalment plan.  The Student will lose the right to pay the remaining course fees by instalments.  The course fee will be recalculated to the original course fee at time of booking in order to recalculate any outstanding balance on the course which will become immediately payable.  A final invoice indicating this will be generated which the Student will be required to pay by bank transfer within 7 days from the date of the invoice to avoid further action to recover the full outstanding balance together with any interest and legal costs incurred by Soothing Touch Academy.

3.4  When a student’s place on the Course is confirmed , all deposits are non-refundable and non-transferable unless the Student gives Soothing Touch Academy 14 days’ notice in writing, from the date of booking with them or until the working day before the course starts, whichever comes first.

3.5  Once the deposit has been paid, if a Student provides a minimum of 14 days’ written notice of cancellation,  or until the working day before the course starts, depending on whichever comes first, a cancellation fee of £50 will be charged before any refunds of the deposit are authorised.  Where payment has been made by PayPal, Iban, credit or debit card the transaction fee / costs will also be deducted from the refund.

3.6  If the full course fees have been paid and a Student provides a minimum of 14 days’ written notice of cancellation from the date of booking or until the working day before the course starts, depending on whichever comes first, a cancellation fee of £50 will be charged before any refunds are authorised.  If the full course fees have been paid by PayPal, Iban, credit or debit card, the transaction fee / costs will also be deducted from the refund.  The Student will be entitled to a refund of 50% of the remainder of the course fee after all deductions have been finalised unless the booking has been made less than 14 days before the course is going to start at which point, no refunds will be given. 

3.7  All course fees including the deposit are non-refundable after the cooling off period has expired. 

3.8  If a Student does not turn up on the first day or cancels their attendance on the first day of the course and / or have given no written notice that the Student will not be attending the course within 14 days of booking on the course, then the Student becomes immediately liable for the full course fee including any outstanding balance which is non refundable and non transferable.

3.9  In the event of a Student failing to complete a course through illness or non-attendance, the Student becomes immediately liable for the balance of the course fee, regardless of whether they have paid in instalments previously unless the Student can satisfy the conditions of clause 3.10 below

3.10  Where a Student is unable to complete a course due to illness, a repayment of a proportion of course fees may be made by the Academy less an admin charge of £100.  Examination fees will not be repaid.  To be eligible for a rebate, the Student must submit a medical certificate stating that they are not fit enough to continue with the course.  A rebate is not payable for absences from classes in any other situation.

3.11  Soothing Touch Academy cannot accept responsibility for Students' changes to work commitments, illness or personal circumstances and will not transfer or refund fees.

3.12  If a course is cancelled due to low numbers or for reasons beyond our control, the course fee remains non-refundable but the Student will be automatically enrolled and can opt to attend the next available course at the venue advertised on the website even if this is a different venue from the original course within the next 12 months after which point the Student would have to pay the full course fee again. 

3.13  If there is an increase in the price of the later course, the Student will be liable for all extra charges at least one month before the course commences. 

3.14  The Academy will not be liable for any expenses incurred by the Student through joining a later course.  If the Academy changes the dates or times of classes, the Academy will not be liable for any additional expenses resulting from those changes.

3.15  The Academy may remove from the Course any Student deemed disruptive to the class, in which case no fees will be refunded but the Student will still be liable for the full cost of the course which will become payable immediately.

3.16  A Student who is disruptive and is removed from the Course will receive an automatic lifetime ban from all current and future courses run by the Academy.

 

4.     Examinations and Fees

4.1  Students may only sit mock and final examinations for the Academy and ITEC once all the Academy and ITEC Course requirements have been satisfactorily completed and all fees have been paid in full.

4.2  No Student will be able to take the final exam without taking a mock exam and if this is not done at the same time as the rest of the students, further costs of £40 per hour will be incurred by the Student which will need to be paid before the mock exams can go ahead and will take place at a time and place convenient to the Principal Tutor and the Student will be responsible for providing a model client for this.

4.2  Students need to be registered with ITEC for examinations.  It is mandatory that a representative of ITEC invigilates the final Examinations.

4.4  Any students having to take examinations independently (ie at a different time to the Examinations for the Course) will incur additional charges of £100 on top of the examination fee which must be paid by bank transfer at least one month in advance of the examination date or invoice date, whichever comes first.

4.5  Where a Student’s delay in reaching examination standard necessitates a late entry, an additional fee of £100.00 must be paid by bank transfer to the Academy before an application can be made for a late booking.

4.6  An administration fee of £150 is payable by a Student to the Academy where the Academy allows them to resit an examination which must be paid by bank transfer at least one month in advance of the examination date or invoice date, whichever comes first.  This fee does not entitle the Student to attend any additional classes.

4.7  Where a Student re-sitting an examination wishes to take additional classes, a proportional payment must be made prior to attending those classes.

4.8  Any Student wishing to take additional classes, must pay the extra fees prior to attending those classes.

 

5.     Cancellation Policy

5.1  All deposits are non-refundable and non-transferable unless the Student gives Soothing Touch Academy 14 working days’ notice in writing, from the date of booking with them or until the working day before the course starts, whichever comes first.

5.10  If the Student chooses not to transfer to the next available course running within the next 12 months, the course fees will remain non refundable and non transferable.

 

6.    Copyright

6.1  All course material supplied by the Academy is copyright to Soothing Touch Academy and students are not authorised to teach this course using this material unless approval has been sought in advance from Soothing Touch Academy.  

6.2  If you are looking to become a tutor please contact us for possible places on our team.  

6.3  However, if you wish to set up on your own due to the strict copyright we have on all of our material, no paragraph, photographs from our website or manuals or any written material given out may be copied, reproduced or transmitted without the written permission of the authors or in accordance with the provisions of Copyright, Designs and Patents Act 1988.

6.4  Any person breaching copyright may be liable to criminal prosecution and a claim for civil damages.

 

7.    Terms 

7.1  This Agreement contains the entire terms of agreement between the parties relating to the subject matter contained in it, and supersedes all prior and contemporaneous agreements, representations, warranties and understandings of the Parties. The Academy's Course Information and Terms and Conditions of Business are correct at the time of printing and may be subject to alteration without prior notice.
